What Are The Building Rules And Regulations In North Yorkshire?

You might be so excited at the prospect of integrating a stylish conservatory or orangery into your property that you have not given consideration to local building rules and regulations. A conservatory / orangery installation is good to go when it fits the following criteria:

  • At ground level and not exceed 30m2 floor area.
  • Glazed to satisfy the requirements of Approved Document K of Schedule 1.
  • Physically separated internally from the building it is attached to, for example, by a door.
  • Without sanitary appliances.
  • Not intended for year round habitable use.
  • Used to some extent for the propagation of plants.

To get a conclusive decision on whether the extension abides by current building rules and regulations, speak to your local authority and ask if they can send you an Exempt Buildings form. Put as much information about the proposed extension as you can on the form prior to submitting it.

You will then receive definitive clarification from them in writing. If it’s good news, you can put forward this document as proof that the extension is legal should anyone question it.  

Planning permission must be met too

Unless your conservatory / orangery is considered to be a “permitted development” you will need to apply for planning permission to the same local authority.

They will have a planning department who will adjudicate and inform you whether it is a “yes” or a “no”.

Once again, we would urge you not to proceed until you are absolutely clear that planning permission is granted as doing otherwise could see you forced to make adjustments or demolish the structure.
